Abstract

The incorporation of Artificial Intelligence (AI) into the legal field is bringing about substantial changes in the administration of justice. This study analyzes the impact of AI, focusing specifically on judicial management and algorithmic support in procedural decision-making, and evaluates its implications for due process, the reasoning behind decisions, and fairness. Objective: To analyze how the adoption of AI tools in procedural and judicial management affects the effectiveness of due process and judicial independence in Colombia. Methodology: A qualitative approach within a socio-critical paradigm and a phenomenological-hermeneutic design, complemented by documentary analysis and comparative law using the “juxtaposition-plus” technique. The field sample consisted of N=12 key participants (judges, prosecutors, litigants, and academics) selected based on intentional criteria of professional experience and interaction with procedural technologies. Results: It was found that, while AI optimizes document flow and speed, critical risks persist, such as algorithmic opacity, a lack of explainability, and a profound territorial gap in technological implementation. The international comparison highlights the need for bias audits and effective human oversight. Conclusions: Specific statutory regulation is required to ensure that algorithmic use is subject to human judgment and proper justification.
